Conditions for the hire of Newton-in-Bowland Village Hall ("the Hall").

The booking of the Hall by the Hirer indicates acceptance of all of the conditions of hire ("the Conditions"). These conditions may not be varied in any way except with the prior written approval of the Chairman of the Committee.

Facilities

The hire includes use of the Hall, kitchen, cloakrooms and use of the refreshment facilities and licensed bar if required. It is the responsibility of the Hirer to set up rooms in the format required prior to the commencement of the hiring.

Fee

The hire fee is payable on receipt of the invoice issued after hiring has taken place. The Hirer shall make all payments under this Agreement on the due date by cheque payable to "Newton Village Hall", or by BACS (sort code 30-96-26, account number 73705268).

Conditions

  1. Overstay. If the Hirer fails to vacate the Hall at the end of the period of hiring, the Committee is entitled to recover an additional sum for each further two-hour period, plus any sums representing the Committee's liability to third parties affected by the late occupation.
  2. Use. The Hirer shall not use any part of the Hall for any purpose other than the purpose of the hiring, nor for any unlawful purpose. No animals except guide dogs are allowed without the consent of the Committee. Nothing may be brought in that endangers the Hall or invalidates its insurance.
  3. Electrical equipment. The Hirer shall not alter, move or interfere with any lighting, heating, power or other electrical fittings. Any electrical appliances brought in must be safe, in good working order and display a current PAT test certificate.
  4. Supervision. During the hiring the Hirer is responsible for the efficient supervision of the Hall, including the control of children; the orderly and safe admission, departure and (in an emergency) evacuation of people; the safety of the Hall; good order and decency; keeping all exit doors unfastened and unobstructed; keeping corridors and firefighting equipment clear; and preventing nuisance or annoyance to neighbours.
  5. Decorations and advertising. The Hirer shall not drive nails, screws, pins or similar into any part of the Hall, nor attach adhesives, fix placards, use highly flammable decorations, or display posters/signs inside or outside without the Committee's consent. The Committee may remove any that become untidy.
  6. Prohibited items. The Hirer shall not take explosive, toxic, hazardous or highly flammable substances into the Hall.
  7. Maximum number. The number of persons admitted must not exceed 200 without the Committee's prior written consent.
  8. Statutory requirements. The Hirer must not breach any statutory requirement affecting the Hall or its insurance, and must comply with all conditions and regulations (fire authority, local authority, etc.), copies of which are available on request.
  9. Children Act 1989. The Hirer is responsible for complying with child-protection matters whilst the Hall is within the Hirer's control.
  10. Sale of alcohol. Alcohol is only permitted under the Committee's licence. No alcohol may be brought onto the premises; it must be purchased through the bar. Please speak to bar staff with any special requirements. A copy of the licence is available on request.
  11. Licence. The Hirer must comply with the Committee's Performing Right Society and Phonographic Performance licences so far as relevant; copies available on request.
  12. Copyright works. The Hirer must not infringe, or allow the infringement of, any third-party copyright.
  13. Use of cameras. Cameras may be used inside the Hall for private (not commercial) purposes, provided no nuisance is caused.
  14. Gambling. No sweepstake, raffle, tombola or lottery is permitted except one that is lawful under the Lotteries and Amusements Act 1976 (as amended) and conducted strictly in accordance with it.
  15. Food. If preparing, serving or selling food, the Hirer must observe all relevant food health and hygiene legislation and regulations.
  16. Smoking. Smoking is not permitted in the Hall.
  17. Expiration of hiring. At the end of the hiring the Hirer must leave the Hall clean, orderly, litter-free and secure: empty all bins into black bags placed at the rear of the Hall; turn off all lights; remove all equipment brought in; and return any moved furniture to its usual position. Items left behind are at the Hirer's own risk and may be charged for storage.
  18. Agreement personal to Hirer. The benefit of the Agreement is personal to the Hirer and cannot be assigned or sub-hired.
  19. Damage to property. The Hirer must take good care of the Hall and its contents and indemnify the Committee for all loss arising from any damage.
  20. Injury and loss. The Committee is not liable for death or injury to any person attending (except where due to the Committee's negligence), nor for loss of or damage to any property brought into or left at the Hall. The Hirer indemnifies the Committee against such losses.
  21. Indemnity. The Hirer indemnifies and holds the Committee harmless against all losses, damages, liabilities, costs, claims and expenses arising directly or indirectly from any breach of these Conditions.
  22. Further exclusions. The Committee is not liable for any loss due to breakdown of machinery, failure of electricity or water, fire, government restriction or act of God causing the Hall to close or the hiring to be interrupted, and gives no warranty that the Hall is fit for any specific purpose.
  23. Right of entry. Authorised members, officers or employees of the Committee may enter the Hall at any time for any authorised purpose.
  24. Termination by Hirer. To cancel, the Hirer must give notice. Any deposit may be forfeited if no alternative hiring is arranged. If notice is given less than one month before the hiring and the Committee cannot re-let, the balance of the fee may be charged.
  25. Termination by Committee. The Committee may cancel on 7 days' written notice, refunding any fee paid; or without notice if the Hall becomes unfit or is needed for an emergency, in which case a full refund of any fee is given.
  26. Breach by Hirer. On any breach, the Committee may recover the cost of remedying it (including attendants, cleaners, etc.) and cancel this or any other hiring without liability to refund.
  27. Notices. All notices must be in writing, delivered by hand or recorded delivery, to the Hirer's address in the Agreement or to the Chairman of the Committee at the Hall.
  28. Amendments. The Committee may revise the hire fees at any time; continued instructions after amendment are deemed acceptance.
  29. Jurisdiction. This Agreement is governed by the law of England, with the exclusive jurisdiction of the courts of England.
  30. Force majeure. Neither party is liable for any default due to act of God, war, strike, fire, flood, tempest or other event beyond reasonable control.
  31. Waiver. No delay in exercising any right operates as a waiver of it.
  32. Severance. If any provision is held illegal or unenforceable, it is deemed removed and the remainder is unaffected.
  33. Third parties. No person who is not a party to this Agreement has any rights under it (Contracts (Rights of Third Parties) Act 1999).
  34. No partnership. Nothing in this Agreement constitutes a partnership or agency between the parties.
  35. Entire agreement. This Agreement is the entire agreement between the parties on its subject matter; neither has relied on any representation not set out in it. Nothing excludes liability for any fraudulent statement or act.
